Network Terms for Movers
Version 1 · draft
These terms are between you, an independent mover, and MoveHappy, LLC ("MoveHappy"). They cover your use of the MoveHappy movers network: the website and tools that let you list where and when you work and let moving companies find you and send you requests.
1. What the network is
MoveHappy runs software. It lets you show moving companies your area, your days, your rate, your equipment and your profile, and lets companies you have chosen, and who have approved you, send you requests for work. MoveHappy does not move anything, does not hire you and is not your employer, agent or customer.
2. You run your own business
You use the network as an independent business: on your own, or through your own company. Nothing in these terms makes you an employee, partner, joint venturer or agent of MoveHappy or of any moving company. You receive no employee benefits, and nobody withholds tax from what you are paid.
3. You choose your work
You decide where you work, which days you work, which companies you work with and which requests you take. You may accept or decline any request. Declining, or not answering, costs you nothing: no penalty, no lower place in any list and no loss of access. There are no minimum hours and no exclusivity. You may use other platforms and serve your own customers at the same time.
4. You decide how the work is done
A company may tell you the result it needs, the place, the time window, its customer's requirements and the safety and legal standards that apply. How you do the work is up to you. MoveHappy requires no training, meetings or uniforms.
5. Your rate and your expenses
You set your own rate and may change it. A company may choose to see only movers at or under a rate it names; that is a filter on whom it sees, not a rate set for you. Each job is paid as its own job, at your rate for that job's hours plus anything you and the company agreed. You pay your own expenses, such as fuel, phone, tools and insurance.
6. Your tools and equipment
You supply your own tools and equipment, as you list them on your profile, and keep them in good working order.
7. Licences
If you carry household goods for pay in Texas in your own vehicle, you are a household goods carrier and must be registered with the Texas Department of Motor Vehicles and carry the insurance it requires. You promise to hold whatever licences and registrations your work needs and to keep them current.
8. Insurance
A company's workers' compensation does not cover you. We recommend that you carry general liability and occupational accident cover. If you list a vehicle, you must give your insurance details and certificate on your profile, and keep them current.
9. Taxes
You are responsible for your own taxes. Before you accept your first request, you give a Form W-9. The company that pays you reports what it paid you when the law requires it (for example on Form 1099-NEC).
10. Background checks
MoveHappy does not run background checks today. If background checks are ever run through a screening company, you will get a separate disclosure and be asked for your written authorization first, and you will get the notices the law requires before any decision is based on a report.
11. Customers' property and information
You are responsible for damage you cause. A customer's name, phone number and address are shared with you only after you accept a request, only for that job, and you must keep them confidential and use them only for that job.
12. Conduct and safety
On every job you act lawfully, work safely, do not work under the influence of alcohol or drugs, and respect the customer's home and belongings. MoveHappy may remove you from the network for a breach of these terms; it will tell you why and give you a short chance to respond first, unless safety requires otherwise.
13. Customers you meet through a company
For a stated period after a job, you will not take a company's customer from a job that company sent you. Nothing else limits whom you may work for or advertise to.
14. Ratings
After a job, you and the company may rate each other. Ratings describe results, not how you must work. A rating never removes you from the network by itself, and you may report a rating you believe is abusive.
15. Disputes
These terms are governed by the laws of the State of Texas. How disputes are settled (in court or by arbitration) will be set out here in the final terms.
16. Changes and electronic records
These terms are versioned. A material change applies to you only after you accept the new version. You agree to receive these terms and related records electronically, and your electronic acceptance is your signature.
17. Ending
You may close your account at any time. Jobs you have already accepted stay between you and the company that sent them.
